Under Georgia workers’ compensation program, the employees must select their authorized treating physician from a “panel of physicians” selected by the employer. This physician determines if and when the injured employee ready to return to work.

Right to a Second Opinion

You have a right to a second opinion. You can see a doctor of your choice – a doctor who is unlikely to be influenced by your employer or its insurance company. You have the right to a one time independent medical exam by a doctor whom you select yourself if you are receiving workers’ compensation wage benefits or if you have received them in the past 120 days. The employer’s insurance company must pay for the medical exam.

Most injured employees are not aware of their right to a one time independent medical exam. The insurance company can deny the employees right to an independent medical exam if the request for the exam is not made correctly.
